Winning
an Aggravated Assault Case
The
client came to the firm charged with assaulting another man by hitting
him repeatedly over the head with a hammer. The man who was hit with the
hammer was admitted to the hospital and required several staples to close
his head wounds.
The client was charged with aggravated assault with intent to cause serious
bodily injury.
Efforts to resolve the matter through negotiation were fruitless - the
best offer made by the Commonwealth would require the client to serve
three to six years in state prison. The Commonwealth threatened to put
the client in jail for twelve years, should he be convicted at trial.
We took the matter to trial and presented the case to a jury. After a
three day trial, the jury returned a verdict of NOT GUILTY on all charges,
except for one count of simple assault.
The client was sentence to NO JAIL TIME whatsoever.
The client
was thrilled.
