Dismissing
More Felony Charges
The
client came to the firm charged with assaulting his ex wife in her home.
He maintained that he was not there at the time, and the Commonwealth
had little solid evidence to work with. Efforts to resolve the matter
through negotiation at the preliminary hearing were fruitless - the Commonwealth
was determined to obtain a conviction against the client.
We interviewed
several witnesses who were willing to testify that the client was not
at the scene when the crime was supposedly committed.
Initially,
the Commonwealth tried to charge the client with burglary, a felony, as
well as other misdemeanor charges. However, after several rounds of aggressive
negotiation, the prosecutor agreed to dismiss all charges, except for
a minor charge of harassment. The client did not have to pay any fines.
The client
was thrilled.
